SARIYER BELEDIYESİNE KARŞI İKİ AYRI DAVA

25.05.2007 tarihinde EHDKD Başkanı Deniz Bingöl ve hukukçuları, Sariyer Cumhuriyet Savcılığına giderek, Saryer Belediye Başkanı Yusuf Tülün, zabıta birimi başkanı ve belediyedeki hayvanları toplamakla sorumlu kişiler hakkında suç duyurusunda bulundular.
Hayvan Hakları Yasası ve Çevre Yasası'na muhalefetten dolayı şikayet içeriği taşıyan duyuruda şu ifadelere yer verildi:
"İlgili işlemi uygulayan idare, sahipsiz hayvanları hiçbir şekilde yaşama şartlarını bilmedikleri ormanlık arazilerde ölüme terketmektedirler. Bu hayvanların o doğal koşullarda yaşaması mümkün değildir. Zaman zaman sahipli ve karneli hayvanları da Kemerburgaz'daki ormanlara götürüp bırakmaktadırlar. Nitekim Lale Halimoğlu isimli yurttaşın karneli köpeği bu şekilde alınmış ve kendisi Sarıyer Sulh Hukuk mahkemesinde Sarıyer Belediyesi aleyhine maddi ve manevi tazminat davası açmıştır.
Kemerburgaz yolunda meydana gelen trafik kazalarının bir bölümü de bu uygulamadan kaynaklanmaktadır. Yola çıkan ve doğal koşulları bilmeyen sahipsiz hayvanlar yüzünden bazı araçlar yoldan çıkmış, devrilmiş ve takla atmıştır. Bu işin bir sorumlusu var ise gerekli önlemleri almadan ve hayvan hakları ile ilgili mevzuata uymadan toplama ve ıslah işlemini gerçekleştiren Sarıyer Belediyesi'dir."

TWO COURT CASES AGAINST SARIYER MUNICIPALITY

In 25 May, 2007, EHDKD Director Deniz Bingol and their attorney at law went to Republican Prosecutor in Sariyer to open a court case against Sariyer Major Yusuf Tulun, head of municipality police and the members of dog catching team.
The summary of the content of the letter of complaint based on the Animal Protection Law is as follows:
“The municipality is dumping stray animals to die in forest areas where they don’t know how to survive. It is impossible for these animals to live in those natural surroundings. From time to time even animals with an owner are also dumped in forests around Kemerburgaz. Lale Halimoglu, a citizen living in the district, has opened a case for compensation of her material and moral loss after her dog was taken by the municipality.
“The traffic accidents in Kemerburgaz road also result from this irresponsible and illegal execution. Some severe traffic accidents occurred because of stray animals jumping to the roads in search of their way to their territory or for food. The responsibility for these is the municipality who collects and rehabilitates dogs not according to the Animal Protection Law and the regulations for its implementation.”

KISIRLAŞTIR AŞILAT ORMANA AT

Istanbul'daki hemen hemen bütün belediyeler, özellikle Küçükçekmece, Beylikdüzü, Bağcılar, Sarıyer, Esenler, Gaziosmanpaşa Belediyeleri, sokak hayvanlarını kısırlaştırdıktan sonra şehrin dışındaki ormanlık alanlara, yoğun olarak da Göktürk, Princci, Imrahor, Taşoluk, Sazlıbosna, Boğazköy, Arnavutköy, Bolluca ve Habibler'e atıyorlar. Hayvanlar ya birbirlerini parçalayarak ya da açlıktan ölüyorlar. Hayvanseverler ve bazı hayvan dernekleri, örneğin SHKD, bu bölgelere atılan hayvanlara yemek taşımaya, sakat, uyuz ve yaralı olanları kurtarmaya çalışıyorlar. Istanbul çevresinde büyük bir katliam yaşanıyor.

Lütfen, onların çığlıklarını duyun, duyurun ve bu katliama duyarsız kalmayın.
Lutfen sokağınızdaki hayvanı alması için belediyeleri aradığınız zaman o hayvanın akıbetinin ne olacağını düşünün.

NEUTER VACCINATE AND DUMP TO FORESTS

Nearly all local municipalities dump dogs to forests after neutering them. Dogs die there either by tearing each other apart or from hunger. Animal protectors and some animal organizations like SHKD are trying to bring food to these dogs and try to rescue those that are wounded, weak or have mange. There is a terrible massacre going on around the cities.

Please, hear the cries coming from nearby forests and don’t be indifferent to this crime.
Please, think about what will happen to the animal when you call a municipality to take it away.

The films you are going to watch below were shot during the feeding and rescue operations of SHKD.

TEPECIK'E ATILAN KÖPEKLER

Büyükçekmece Gölünün Tepecik Mevkii’ne yaklaşık bir ay önce 35 köpek atılmıştı.
Aynı yere geçenlerde 10 köpek daha bırakıldı. Bazıları iskelet gibi. Çoğu mavi küpeli. Yeni kısırlaştırılmış. Birkaç tane IBB küpeli olan köpek de var. Yukarıdaki fotograflardan birinde, bir ay önce atıldıktan sonra ölen bir köpeğin kafasını yeni bırakılanlardan birinin yediğini görüyorsunuz.

Belediyelerin vahşi uygulaması devam ediyor.

DOGS DUMPED AT TEPECIK

Nearly one month ago 35 dogs were dumped at Tepecik District near Buyukcekmece Lake. 10 new dogs were dumped there recently. Some of them are are so thin to look like skeletons. Most of them have blue tags. Some have white tags of Istanbul Municipality. In one of the photographs above, you can see one new comer eating the bones of a dog dumped which died after being dumped there one month ago.

The brutal execution of the municipalities continues.

SAYIN BAYAN VERHEUGEN ISTANBUL BÜYÜKŞEHİR BELEDİYE BAŞKANI SAYIN KADİR TOPBAŞ'I ZİYARET ETTİ

Avrupa Parlamentosu Başkan Yardımcısı Sayın Günter Verheugen'in eşi ve Pro Animale Derneğinin iyi niyet elçisi Sayın Gabrielle Verheugen ve Pro Animale Derneği başkanı Sayın Wothke 17 Nisan, 2007'de, Istanbul’da uygulanan kısırlaştırma projesi hakkında görüsmek üzere Istanbul Büyükşehir Belediye Başkanı Sayın Kadir Topbaş’ı ziyaret etti.

Sayın Verheugen, Bursa Osmangazi Belediyesi tarafından yaptırılan rehabilitasyon merkezinin tüm Avrupa için örnek bir tesis olduğundan ve Pro Animale derneğinin öncülüğünde gerçekleştirilen Karacabey Ayı Merkezinden bahsettikten sonra kısırlaştırma projesinin Istanbul gibi çok büyük bir şehirde uygulanmasının ne kadar zor olduğunun bilincinde olduklarını hatırlatarak, IBB’nin bu konuda Avrupa’dan her türlü eğitim ve danışmanlık yardımı alma talebine yardımcı olmaya hazır olduklarını belirtti.
Toplantıda bulunan dernek temsilcimiz, kısırlaştırılan sokak hayvanlarının birçok yerel belediye tarafından ormanlara atıldığını hatırlatarak bu uygulamanın önlenmesi isteğini dile getirdi.

Sayın Kadir Topbas, Sağlık Daire Başkanı Sayın Mehmet Yıldırım’a yerel belediyelerin yetkililerini bir toplantıya çağırarak, kısırlaştırma uygulamasında belediyeler arasında koordinasyon sağlamasını temin etmesi talimatını verdi.

Bayan Verheugen, EHDKD’nin bu konuyu kendisi adına takip edeceğini ve kendisini bilgilendireceğini hatırlatarak bu toplantıların başarılı olmasını temenni ettiğini belirtti ve bu ziyaretin Istanbul’daki sokak hayvanları için bir umut olmasını diledi.

MS. VERHEUGEN VISITED ISTANBUL MAJOR MR KADIR TOPBAS

On April 17, 2007, Ms Verheugen, European Parliament Vice President Günter Verheugen's wife and ambassador of good will for Pro Animale and president of Pro Animale Ms. Wothke visited Istanbul Major Mr Kadir Topbas.

Ms. Verheugen after mentioning about the success of the Rehabilitation Center in Osmangazi which she admitted to be exemplary for all Europe, and referring to the Karacabey Bear Center supported by Pro Animale, she said she is aware of the fact that implementing neutering project in Istanbul is a huge task. She offered to do all she can to provide any consultancy or educational help needed from EU for a successful implementation of the project for solving the stray dog problem of Istanbul.

Our representative who was also at the meeting, reminded the Major about dogs dumped in forests after being neutered by many regional municipalities.

Mr. Topbas gave an instruction to Mr. Mehmet Yildirim the head of the Health Department to organize a meeting and invite all managers of veterinary departments of regional municipalities with the purpose of achieving a coordination between the municipalities. Ms Verheugen reminded Mr Yildirim that EHDKD will be in close contact with him representing herself to take information about the outcomes of the meeting and expressed her wish that this meeting will be hopeful for the stray animals of Istanbul.

KATLİAM DEVAM EDİYOR

Sayın Güler Gülhan’dan aldığımız mektupta şöyle diyor:

“Birbuçuk yıl önce Büyükçekmece Gölünün kenarında, Tepecik Mevkiine 60 kadar kısırlaştırılmış köpek atılmıştı. Biz, bu köpekleri gün aşırı beslemeye gidiyorduk. Geçtiğimiz günlerde, aynı bölgeye toplama kampından çıkmışcasına bir deri bir kemik 35 köpek daha atıldı. Aralarında avuç içi büyüklüğünde yavrularıyla birlikte atılan anneler de var. Buraya daha önce atılmış köpekler yeni gelenleri bölgelerine kabul etmedikleri için, yemek yemeğe gelmeye dahi korkuyorlar. Hepsi perişan durumda. Bu köpeklerin kulağında Istanbul Büyükşehir Belediyesi’ne ait beyaz küpeler var. Küpelerin üzerinde hangi bölgeden alındıklarını gösteren numara yok. Yavruları sahiplendirmek için evime aldım. Oraya götürecek yemek bulmakta zorluk çekiyorum.”


Tarihci Murat Bardakçı’nın yazdığına göre, 19. yüzyılın ilk çeyreğinde, Ikinci Mahmut zamanında Istanbul’daki tüm köpekler yakalanıp Hayırsızada’ya gönderildiğinde halk, “Hayvanlara eziyet etmek uğursuzluk getirir, başımıza iş açılır, köpekleri orada bırakmayalım” diye homurdanınca sağ kalan köpekler teknelere konulup tekrar Istanbul sokaklarına salınmış.

Ne yazık ki, bugün ne Istanbul halkı, ne de sehrin yerel yöneticileri 19.yüzyılın ilk çeyreğinde yaşayan atalarımızın gösterdiği hassasiyeti göstermiyorlar.

Bu katliam ne zaman bitecek? Istanbul'lular ormanlardan gelen bu çığlıkları ne zaman duyacaklar?

MASSACRE IS CONTINUING

Ms. Guler Gulhan sent the following e-mail:

“About sixty neutered dogs were dumped in Tepecik area near Buyukcemece Lake, one and a half years ago. We were going there to feed the dogs every other day of the week. Last week, thirty five more dogs were dumped at the same area. They were as skinny as they were coming from a concentration camp and some of them were mothers with babies as big as the palm of one’s hand. The new comers are even afraid to come to eat what we bring them because the ones that were dumped there before don’t accept them in the territory. All of them are in appalling condition. These dogs have Istanbul Municipality tags in their ears without any numbers showing from which area they were collected. I have taken the puppies home for rehoming. I have difficulty finding food to bring them.”

Historian Murat Bardakci wrote that in the first quarter of 19th century, under the rule of Mahmut the Second, all Istanbul dogs were collected and dumped in Oxeia Island. The citizens who heard the cries of dogs protested by saying: “Torturing dogs will bring us bad luck. Bring the dogs back.” The dogs which survived were brought back to the city and released in the streets.

Unfortunately, today, neither the citizens of Istanbul, nor the local governments show the same sensitivity as our ancestors did.

When will this massacre stop? When will the citizens of Istanbul hear the cries coming from the forests and far away areas?

Onu Belgrad ormanında bulmuştuk. Chip numarasından araştırdığımızda, Istanbul Büyükşehir Belediyesi tarafından Habibler Kum Ocağından alındığını öğrendik. Bulduğumuz yerden en az 30 kilometre uzaktan alınmış ve ormana atılmıştı. Perişan haldeydi. Onu SHKD barınağına götürdük. Adını Cesur koyduk.

Aradan aylar geçti. Tedavi edildi. Şimdi sağlıklı ve mutlu.

We had found him in the Belgrad forest in a miserable condition. We found out, from his chip number, that he was taken from Habibler Sand Mines which was about 30 km away from where we found him. We took him to SHKD shelter for medical treatment. We named him Cesur- meaning brave.

Months passed by. He was medically treated. Now he is healthy and happy.

We thank SHKD and Veterinary Technician Omer Atis who treated him with affection.

We ask to all those that are responsible of this : How can you sleep peacfully with the responsibility of hundereds of dogs you have thrown in forests, far away from the places they belong.? Are you aware of the fact that this execution is against the Animal Protection Law?

Bir okuyucu mektubu: Sevgili Christine Ulrich'in son günlerde Istanbul'da yasanan dehşetle ilgili yorumunu sunuyoruz:

"1910 yılında, yüz yıldan daha kısa bir süre önce Istanbul’daki bütün köpekler toplanıp Hayırsızada’ya atılmış; orada açlık ve susuzluktan ölüme terkedilmişti. Aynı trajedi bugün tekrar yaşanmaktadır.

"Şu farkla ki : Bu sefer atıldıkları ormanlardan gelen çığlıklar şehirden duyulmamaktadır.

"Şu farkla ki: Bu hayvanlar kısırlaştırılmış, aşılanmış, bunu gösterecek şekilde kulaklarına küpe takılmıştır. Bazıları yıllarca önce kısırlaştırılmış olan, insanların benimsediği ve baktığı köpeklerdir.

"Şu farkla ki: Bu hayvanların çoğu, deneyimsiz belediye veterinerleri tarafından, bazıları daha bebekken yanlış kısırlaştırıldıkları için hasta ve kanamalıdırlar.

"Fakat hiçbir şey değişmemiştir.

Hayvanseverler bu nedenle ormanlara yemek taşımak için helak olmaktadırlar- kızgın taşın üzerine dökülen bir damla su mu?- Hayır bir umut çığlığı!

Are They Heading for a New Marmara Tragedy?

Comment from Dear Christine Ulrich about what is going on lately in Istanbul:

"Barely a hundred years after stray dogs of Istanbul were brought to the Isle of Hayirsizada in the Marmara Sea to starve there. The same misery seems to repeat.

"Difference: Today the dogs are thrown into the forests, similar to islands, from where the cries of the animals can hardly be heard.

"Difference: These animals had been neutered, vaccinated and tagged before, some of them already years ago. Some of them are dogs that have been cared for and fed by inhabitants.

"Difference: These animals are sick and bleeding because they were carelessly neutered by unexperienced municipality vets, some of them when they were only puppies.

"Difference: This is 2007 and not the mere beginning of the 20th century.


"But nothing has changed.

"ON THE CONTRARY:


"In the woods surrounding Istanbul, dogs are starving to death, without any food, without even water. Those are the dogs that the animal loving inhabitants of Istanbul miss from their deepest hearts. Yes, that’s why animal lovers try to help by bringing food – a drop on the hot stone... no, a signal!

"Mr Arif Eker also sends food – what a disgusting hypocresy."

BOLLUCA

Neredeyse tüm yerel belediyeler ve IBB’nin, köpekleri kısırlaştırıldıktan sonra ya da kısırlaştırmadan, daha önce hayvan koruma dernekleri tarafından kısırlaştırılanlar da dahil olmak üzere, ormanlara atmaları sonucunda bu hayvanların bir kısmı açlıktan telef olurken, diğer bazıları da civar köylere sığınmaktadır. Ne yazık ki hayvanların biraz yemek bulmak için gittikleri bu köylerde başlarına gelenler de içler acısıdır. Köy halkı bu davetsiz misafirleri istememekte, zaman zaman fare zehiriyle itlaf etmektedir.

Bolluca bu köylerden biridir. Bir yandan hayvanseverler ormana atılmış köpeklere yiyecek götürmek için insanüstü bir özveriyle koştururken, diğer yandan köylüler köye sığınmaya çalışan köpekleri öldürmekle tehdit etmektedirler. Bircok hayvan bu şekilde zehirlenerek öldürüldükten sonra hayvanseverler kurtardıkları 13 köpeği, kiraladıklari metruk bir gecekondunun bodrumuna kilitleyerek koruma altına almışlardır.

Oraya gittiğimizde, güneş girmeyen bu bodrumda hapsedilmiş irili ufaklı 13 köpeği görünce dayanamadık, SHKD’den yardım istedik ve onları SHKD barınağına götürdük.

Ne ormanlara yemek götürmek, ne hayvanları zehirlenmesinler diye kömürlüklere tıkmak, ne de kurtarıp barınaklara götürmek çözüm değildir. Belediyeler Hayvan Hakları Yasasını uygulamak, yani hayvanları kısırlaştırdıktan sonra yerine bırakmak zorundadırlar. Halkın kısırlaştırılıp yerine bırakılan köpeklere tahammül göstermesi için ikna edilmesi gerekmektedir.

Bütün bunlar, belediyelerin, isteksiz, yetersiz, yillardir itlafa alısmıs kadrolarının kısırlaştırıp yerine bırakma projesini becemediğinin, bu projenin başarılı olması için, dünyadaki bircok yerde olduğu gibi hayvan koruma örgütlerinin denetimi ve isbirliğinin gerektiğinin açık delilidir. Belediyeler bu projeyi de yüzlerine gözlerine bulaştırmış ve köpeklere sistematik işkenceye dönüştürmüşlerdir.

BOLLUCA

All municipalities including the Istanbul Metropolitan Municipality has been throwing dogs into forests near the city after or before neutering them including those that have been neutered long before by animal societies. While some of these dogs starve to death in forests some of them try to find a shelter in nearby suburban districts. Unfortunately nothing but disaster is waiting for them in these villages. The people there don’t want these unexpected visitors and usually poison them.

Bolluca is one of these villages. While animal lovers try to bring food to those animals dumped in the forests by municipalities, they also try to rescue the ones at the villages from being poisoned by the people there. After many dogs were poisoned by the villagers of Bolluca, animal lovers have rent an incomplete construction site to put 13 dogs in a dark attic to save them from being poisoned.

When we went to the place, the condition of the 13 dogs in the attic where animal lovers brought food twice a week were miserable. We asked for help from SHKD who kindly accepted to rescue these dogs and gave a place to them in its shelter.

Neither taking food to forests, nor putting dogs to dark attics or putting them into shelters is a solution. The municipalities have to act according to the Animal Protection Law and put the neutered dogs back to where they belong. The public should be persuaded to tolerate the dogs that are put back to where they belong.

All these show that the unmotivated, inefficient municipality employees who are used to poisoning dogs for years can not implement the project of neuter and release. For this project to be successful, the cooperation and supervision of animal protection organizations is necessary as is the practice in many cities of the world. The municipalities have made a mess of the project of neuter and release and have turned it to a project of torture for dogs.

ISTANBUL'UN TÜM İLÇELERİNDE KATLİAM

Dün, Sarıyer Belediyesi ekiplerinin Arıköy Sitesinden, çoğu daha önce EHDKD tarafından kısırlaştırılmış, hepsi küpeli 20 köpeği aldığını öğrendik. Bu köpeklerden özellikle bir tanesi daha önce Anadolu Ilaç Gıda Şirketinin deneyimsiz veterinerleri tarafından yanlış kısırlaştırıldığı için sürekli kanaması olan bir köpekti. Köpek toplama timinin başı Korhan Edebali’yi aradık. Köpeklerin alındığını doğruladı ve geri getirilmeyeceklerini söyledi. Hayvan Hakları Yasasına göre kısır ve aşılı hayvanların yerlerine bırakılmaları geektiğini söylediğimizde, bu durumun sadece sahipli hayvanlar için söz konusu olduğunu iddia etti. Uzun bir tartışma sonucunda, kanundan birhaber olduğu, ya da aldığı talimatın kanuna aykırı olduğundan emin olduk. Israrla bütün sahipsiz hayvanların toplanmasını savunuyordu. Toplanan bu hayvanların akıbeti ile ilgili sorularımıza ise, “başka yerlere bırakılıyor” gibi anlamsız cevaplar veriliyordu. Bu hayvanları Sarıyer civarındaki ormanlara attıklarını herkes biliyor.

Bu icraat ne yazık ki sadece Sarıyer Belediyesine özgü değildir. Hemen hemen tüm yerel belediyeler ve Istanbul Büyükşehir Belediyesi hayvanları topladıktan sonra kısırlaştırıp ya da kısırlaştırmadan ormanlara atılmakta ya da yok etmektedir. Ormanlara atmakla yok etmek arasında hiçbir fark yoktur. Ormana atılan köpekler de açlıktan izdirap çekerek ölmektedir.

Arif Eker’in ormanlara yemek gönderme teklifi hayvanseverleri oyalamaya yönelik ucuz bir manevradır. Daha ameliyat yerleri bile iyileşmeden ormana atılan yetişkin ve bebek köpekler, çaresizlik içinde ölmektedir.

Bu katliama karşı kendi ilçe belediyesini uyarmak herkesin görevidir.

MASSACRE IN ALL THE DISTRICTS OF ISTANBUL

Yesterday we were informed that the Sariyer Municipality dog catching team has collected 20 dogs from Arikoy. Most of these dogs were previously neutered and vaccinated by EHDKD and especially one of them was improperly neutered by the AIG’s incompetent vets and had been bleeding since then. We reached the head of the catching team, Korhan Edibali, who ruthlessly told us that it was the duty of the municipality to collect all dogs which don’t have an owner even if they had a tag showing that they were neutered and vaccinated. And he added that the collected animals were released in “other places” which clearly means the forests as all forests surrounding the city are full of dogs left there to starve to death. This execution is against the Animal Protection Law 5199 which says that it is the duty of the municipalities to neuter and vaccinate all stray animals and release them at where they were taken from.

Unfortunately all district municipalities as well as the Istanbul Metropolitan Municipality are doing the same. They are collecting all stray dogs and dumping them in forests, either before or after neutering them. Forests that surround the city are full of dogs starving to death. Sending food to the forests is a cheap maneuver taken by Arif Eker to fool the animal lovers for the solution is not to take food to forests but to stop dumping dogs to forests and do what the Animal Protection Law says.

All animal protectors should protest this illegal action by calling the region municipality where they live.

ARİF EKER! YETER!

Kulağında Istanbul Büyükşehir Belediyesi küpesini taşıyan bu köpek üç aylıktır ve ameliyat yeri üzerindeki gazlıbez dahi çıkarılmadan Bolluca'ya atılmış ve orada ölmüştür. Diğer fotoğrafta ise yine o bölgeye atılan diğer köpekler görülmektedir.

Görüldüğü gibi, hiçbir şey değişmemiştir. Istanbul Büyükşehir Belediyesi Veteriner Işleri Müdürlüğünün icraati aynen devam etmektedir. Köpekler yine, özensiz bir şekilde ameliyat edildikten sonra, daha yaraları bile iyileşmeden alındıkları yere değil, özellikle uzak bölgelere, ormanlara atılarak ölüme terkedilmektedir. Hayvanseverler haftanın belli günleri, yerleşim alanından uzak yerlere atılan hayvanlara yemek taşımakta, hasta ve yaralı olanların tedavilerini yapmaktadırlar.



Bu zulüm ne zaman bitecek? Yüreklerimizi yaralayan bu sahneleri daha ne kadar görmeye devam edeceğiz? Bu cinayetin sorumluları ne zaman hayvanların da Tanrı'nın ümmeti olduğunu hatırlayacaklar?



ARIF EKER! STOP THIS TORTURE!

These pictures were taken in a nearby distict of Istanbul. The dead dog with the Istanbul Municipality's tag on his ear, in the first three pictures is only three months old, operated, and dumped with the qauze on its wound. The other picture shows dogs dumped at the area where there is nothing available to eat. Animal portectors are trying to carry food to this place once or twice a week.


As is seen in the pictures, nothing has changed about the execution of Istanbul Metropolitan Municipality Veterinary Department. Dogs operated in a careless way, by unexperienced vets and dumped even before their wounds have healed to far away places where they don't belong, where they can find no food or water.


When will this torture stop! When will we not be seeing these appaling pictures. When will those who are responsible for these realize that these animals are also God's creatures deserving the right to live.

Robert Smith Avrupa'daki tüm hayvan korumacılar tarafından sadece Istanbul'daki değil Romanya'daki "kısırlaştır- aşılat-yaşat" projelerinin mimarı olarak bilinmektedir. Kendisi Istanbul'un birçok ilçesindeki kısırlaştırma çalışmalarını finanse etmiştir. 1998'den beri Türkiye'deki 20.000 sokak köpeğine ücretsiz tıbbi tedavi yapılmasını sağlamıştır. Belediyeler tarafından Hasdal çöplüğünde açlıktan ölüme terkedilmiş olan 1000 köpeği kurtarıp tedavi ettikten sonra barınağında bakılmalarını finanse etmiştir.

Susen Erkuş kıymeti kendinden menkul, herkesce malum bir "hayvansever"dir ve yaptığı bu gerçekdışı ithamların hesabını adalet önünde verecektir. Bu güne kadar hiçbir savcı ya da polis, her mantıklı insan gibi bu gülünç ve akıl dışı iddiaların hiçbirini ciddiye almaya değer görmemiştir.

Son üç aydır, Feyza Algan'a ait olup SHKD barınağında kalan iki köpeğin tüm masrafları, barınakta kalan, kurtarılmış diğer 250 köpekle birlikte Robert Smith tarafından ödenmektedir. Bu köpekler, sahiplerinin sütünundaki gerçekdışı suçlamalardan sorumlu tutulamayacağından, SHKD onlara yardım etmeye devam edecektir. Feyza Algan onların masraflarına katılmak için hiçbir teşebbüste bulunmadığı gibi, onları ziyaret etmeye bile zahmet etmemiştir.

PREPOSTEROUS LIES

The letter below was published recently in Feyz Algan-Guzin Abla’s column; this journalist is a well known agony aunt who answers readers’ questions about their personal and sexual problems. The letter below was concocted by Susen Erkus. Every single allegation is a lie. There is hardly a word of truth in it. Many of the accusations are not only false, they are illogical and contradictory. Even responding to such nonsense is to take Susen Erkus seriously, which she hardly deserves. We do not intend to sink to her level by trading accusations.

Robert Smith is well known to animal lovers all over Europe as the architect of Neuter & Return projects not only in Istanbul but in many parts of Romania. He has financed Neuter & Return in many districts of Istanbul. He has provided free veterinary care to 20,000 Turkish dogs since 1998. He alone rescued and cared for over 1000 dogs abandoned by municipalities on the Hasdal rubbish dump, when other Turkish animal welfare groups refused to help these starving animals.

Susen Erkus is an infamous and self-proclaimed animal lover who will be held accountable for these paranoid accusations. The reason of course that the public prosecutor and police have taken no action against Robert Smith and SHKD is that they know, as does any reasonable person, that there is no truth in these absurd and sickening allegations.

For the last 3 months Robert Smith has been paying for the accommodation and care of Feyza Algan’s own two dogs, together with 250 other rescued dogs, at the shelter he finances. Since these dogs are not to blame for the libellous accusations in their owner’s column, SHKD will continue to care for them, despite the fact that Feyza Algan pays nothing towards their upkeep and cannot even be bothered to visit them.

‘Guzin Abla,
I am a member of DOSHAYAD and the Animal Protection Committee of the City of Istanbul. Furthermore, in my own association which is under the umbrella of the Istanbul Environment Council, I have undertaken the roles of Secretary and Consultancy for many years.

During these years we fought with Municipalities for the killing, we dealt with people who organized dog and rooster fights. We made serious progress with our friends in these endeavors. However, there is a group we have really been struggling with for the past 10 years, but the officials have never paid attention, they don’t see or hear.

Unfortunately, this group was formed under the false pretences of protecting the animals with the collaboration of two associations and it is headed by a British Citizen who has been living in this country since 1994. I myself as an animal lover was working in the field at that time. In 1996 when I was working as a consultant to the Bakirkoy Mayor, this person told me ‘we should re-home the strays outside of Turkey’. When I said ‘Aren’t there enough dogs outside of Turkey, why would they love our poor worn out dogs?’, he told me that there was a lot of demand from the Netherlands, Switzerland and especially Germany.

I told him that two people should be going with the animals and recording the addresses of their new homes one by one. As I insisted, he asked me ‘what would be my gain in that case’ so I answered ‘You are getting a 10 million dollar fund from the World Health Organization. What else would you expect to gain?’

Since that day I and my friends have continued with this struggle. At that time we were in the minority. Animal lovers who believed him and fought against us (especially targeting myself) were many in number. After this dialogue, they established their associations to undermine me and people who think like me. And we established DOSHAYAD to fight with so-called animal lovers who are after unearned income (rantiye).

Especially between 1996 and 2004 hundreds of thousands of dogs were sent abroad to be killed. In the meantime factories were established in China to process dog skin. This person set up shelters and offices in many countries in Europe, Bulgaria, Middle East, and Far East. The point that is most disappointing about all this is that, before all of this shipping, negative propaganda about Turkish people is spread on the Internet abroad. On the 2nd of April 2003 we caught a branch of these people at the Ataturk Airport. We could only confiscate the last one of the 3 groups of animals which were being sent that day. No official papers were found in the legal investigation.

In the night of the 17th of June 2006 we caught them at the Ataturk Airport again and confiscated the dogs. There was no result even though legal action was taken again. We had support and help from the Chief of Airport Customs Protection. In the first week of the month of September we also blocked the passage of dogs from the Edirne-Kapikule Customs. The Edirne Chief of Police helped us. We owe him gratitude.

We demanded from the gendarme located near the Gokturk Shelter of this association that an investigation be held about the foreign workers who are being employed illegally, dogs which are being transported abroad illegally and the people who prepare illegal papers to transport these dogs abroad. We and the Animal Protection Association in Germany who supports us have repeatedly informed relevant officials that this group operates in affiliated shelters in Antalya, Alanya, Fethiye, and Ayvalik. Unfortunately, no measures were taken. The shipping still goes on.

Please! What we ask from you is to help us make our voice heard by our government to save our poor animal friends from this dreadful end.

SUÇ DUYURUSU - CRIME DECLARATION

Abana Kaymakamlığı Tarım Ilçe Müdürlüğünün Abana Belediyesine yazdiği bu yazıda referans yapılan 3285 sayılı yönetmeliğin ilgili maddesi sadece kuduz görülen karantina bölgelerinde uygulanmak içindir. Oysa bu yazıda, kuduz karantinasından hiç sözedilmemekte ve sahibinin ismiyle kayıt altına alınmamış tüm hayvanların öldürüleceği ima edilmektedir. Yani, sahipsiz tüm hayvanların yanı sıra kayıt altına alınmamış sahipli hayvanların da itlaf edileceği anlaşılmaktadır. Bu resmi yazi, Hayvan Hakları Yasasına aykırıdır ve bu yazıyı yazan kurum suç işlemektedir.

VE KANUNA AYKIRI ANONS DÜZELTİLDİ

Bugün derneğimize gönderilen asagidaki yazı ile kanuna aykırı anonsun düzeltildiği bildirilmiştir. Bu örnek, sivil toplum örgütlerinin hukuk devletinin oluşmasındaki hayati rolünü göstermesi açısından çok önemlidir. Idareyi kanunlara aykırı icraat konusunda uyaran herkese teşekkür ederiz.

Valilik Makamı İl Tarım Müdürlüğünce, İlçe Tarım Müdürlüğüne gönderilen 24.2.2007 tarih ve 586 sayılı "Köpek ve Kedi Sayısı" konulu yazılarında; İl Hayvan Koruma Kurulu Kararı gereğince, köpek ve kedilerin sahiplerinin isim ve soyadlarının yazılarak kayıt altına alınmasının istenilmesi üzerine, İlçe Tarım Müdürlüğünce, Belediye hoparlöründen halka duyurulması amacıyla, İlçe Beledisine gönderilen 05.02.2007 tarih ve 42 sayılı yazıda; "3285 sayılı Hayvan Sağlığı ve Zabıtası Yönetmeliğinden alıntı yapıldığı", İlçe Tarım Müdürlüğünce İlan metni hazırlanmadan yazı olarak verilen duyurunun, Belediye görevlilerince İlçe Tarım Müdürlüğü yazısında yer verilen "…....... yönetmeliğinin 119. maddesinin g fıkrası gereği, şüpheli kedi ve köpeklerin kuduz hastalığına karşı aşılanması mecburidir. Şehirlerde Belediyeler, Köylerde Muhtarlıklar sahipli köpek ve kedilerin kaydını tutar, kayıtlar hükümet veterinerince denetlenir, köpekler üç, kediler altı aylık olduklarında ilk defa aşılanır ve bu aşılar her yıl tekrarlanır. Aşılanan hayvanlar için aşı belgesi düzenlenir, belgesizler öldürülür ve imha edilir" denilmekle, ilgi yönetmelikten alıntı yapılarak hoparlörden okunan, yönetmeliğin son cümlesindeki " Belgesizler Öldürülür ve İmha Edilir" ibaresi, vatandaşlar tarafından yanlış anlaşılmaya yol açmıştır.

3285 sayılı Kanun gereğince hazırlanan yönetmeliğin belirtilen maddesi gereği yapılabilecek işlemlerin,5199 sayılı " Hayvanları Koruma Kanunu" çerçevesinde değerlendirme zorunluluğu olduğundan, konunun hassasiyeti ve vatandaşlarımız tarafından yanlış anlaşılmanın bertaraftı için İlçe Tarım müdürlüğünce yanlış yapılan anons'un düzeltilmesi sağlanmıştır.

Kaldı ki; yürürlükteki Kanunlarla, bu tür bir işlemin Hükümet veteriner hekimi onayı olmadan gerçekleştirilmesi mümkün değildir.

İlçemiz, turistik bir ilçe olması sebebiyle, yok denecek kadar az miktardaki sokak hayvanlarına, gerek Kaymakamlığımız gerekse, İlçe Belediyesi ve duyarlı vatandaşlarımız birlikteliğinde sahip çıkılmakta olup, Belediye Başkanlığımızca sahipsiz hayvanların barınmaları sağlanması için, hayvan barınağı yapım çalışmaları sürdürülmektedir.
Bu sebeple hayvanların yok edilmesi söz konusu olmayıp, konu yanlış anlamadan kaynaklanmıştır.

CRIME DECLARATION

From: ABANA District Government Agriculture Department

To: ABANA Municipality

‘It is compulsory to vaccinate suspicious cats and dogs against rabies’ according to item number 119 of the Ministry of Agriculture and Village Affairs Protection and Control Department regulation number 3285 for Animal Health. This regulation says ‘Municipalities in the cities and mukhtar in the villages keep records of owned dogs and cats. These records are audited by government vets. Dogs are vaccinated when they reach 3 months of age and cats are vaccinated at 6 months for the first time. Vaccinations should be repeated every year after that. A vaccine record is kept for these animals. Animals without vaccine papers are killed and annihilated’. It is according to this regulation that the ‘Animal Protection Council’ of our city has decided in a meeting headed by the assistant governor Nurettin Ates on 25.12.2006 for the municipalities to keep record of the cats and dogs in the cities.

For this reason, owners of cats and dogs in our district need to be recorded by providing their names and last names and these records need to be completed and sent to the District Agriculture Department by 23.02.2007.

In this letter written by the Abana District Government Agriculture Department to Abana Municipality, a reference is made to the regulation no. 3285 in which it says that all animals that are not registered by the name of their owners will be killed. The referred article of the regulation is only applicable when the district is announced to be a quarantine area as a result of the identification of a rabies incident. Whereas, in this official letter, the article is isolated from its content and referred to as a general case. From this we understand that it is planned that all stray animals and owned animals that are not registered will be killed. This letter is clearly in contradiction to the Animal Protection Law and so the institution writing this is committing a crime.

AND TODAY THE ANNOUNCEMENT WAS CORRECTED

In the letter we received today as an answer to our post, Mr Aksoy, the Governor of Abana says: “the announcement made on public loudspeakers that all unregistered animals will be killed and destroyed was a mistake made my the Agriculture City Management and was misunderstood by the public. The announcement was corrected, taking into consideration the fact that all operations must be in conformity with the Animal Protection Law.”

We thank everybody who warned the administration about acting in conformity with the law. We think this is a good example showing the crutial role of NGO's in making a state of law.

Neutering Operations at Municipality Shelters

Kısırlaştırma operasyonlarının artık karın altından çok küçük bir delikten yapıldığı (deligin büyüklüğü endoskopik yöntemdeki kadardır) günümüzde hala bu terk edilmiş yöntemin kullanılıyor olması belediye barınaklarında çalışan veterinerlerin birikimini ve kurumun hayvanlara yaklaşımını açıkça ortaya koymaktadır.

Bu yöntemin terkedilmiş olmasının nedeni başarısız olma ihtimalinin yüksek olması ve ameliyattan sonra resimde de görüldüğü gibi ikinci bir pansuman dikişine ihtiyaç göstermesi ve bu nedenle iyileşme süresinin en az 10 gün olmasıdır. Oysa karın altından yapılan yöntemde deliğe dikiş atılmadığı için hayvanın yalama riski yoktur, yara iki gün sonra iyileşir ve hayvanın sıkıntısı biter. Hayvan maksimum 5 gün içinde alındığı yere salıverilebilir.


These photographs were taken at a shelter which belongs to the Istanbul Metropolitan Municipality. The application of this abandoned operation technique instead of the endoscopic one which is widely used by veterinerians today shows the inexperience of municipality veterinaries as well as the inhumane and merciless approach of the municipality towards animals.

The reason for abandoning of the old technique is the low probability of its success and the necessity of making a second dressing stitch as a result of which the recovery period is at least 10 days. Whereas, in the new endoschopic technique, no stitch is needed and the animal recovers in two days and can be released at most in five days.
